Club Terms & Conditions 

Thank you so much for your interest in Mountain Hart Dive Club! We are so excited to meet you and share our love of the sport with you!

Photo/Video Release

This is for the purpose of marketing as well as social media.

I hereby give permission for my child(ren) to be photographed/videoed by a representative of Mountain Hart Dive Club LLC during events, classes, and special activities, and I give permission for those photos/videos to be used, without restriction as to changes or alterations, for advertising, promotion, exhibition, or any other lawful purposes, including social media. I waive any right to inspect or approve the photographs/videos that may be used now or in the future, whether that use is known or unknown to me, and I acknowledge that I understand that there will not be any compensation arising from the use of any of the photos/videos.

Mandatory Membership For Insurance

We are Currently run under the umbrella of AAU and their insurance, in order to participate in any of our practices or functions you will be required to have a valid AAU membership number. 

Realease of Liability

In consideration of participating in hazardous activities with Mountain Hart Dive Club LLC at Thompson School District Aquatic Facilities, UNCo Bank of Colorado Pool in Greeley, or other training areas, I represent that I understand the nature of this activity and that my child(ren) is/are in good health and in proper physical condition to participate in such activities. I acknowledge that if I believe event conditions are unsafe, I will immediately have my child(ren) discontinue participation in the activity. I fully understand that this activity involves risks of serious bodily injury, including permanent disability, paralysis, and death, which may be caused by the actions, or inactions, of my child(ren), those of others participating in the event, the conditions in which the event takes place, or the negligence of the “releasees” named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, cost, and damages that my child(ren) incur as a result of their participation in the activity.

I hereby release, discharge, and covenant not to sue Mountain Hart Dive Club LLC, its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of premises on which the activity takes place, each considered one of the in whole or part, by the negligence of the “releasees” or otherwise, including negligent rescue operations and further agree that if, despite this waiver and release of liability, and assumption of risk, I or anyone on my behalf, makes a claim against any of the releasees, I will indemnify, save, and hold harmless each of the releasees from any loss, liability, damage, or cost, which any may occur as the result of such claim.

I have read the RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, understand that I have given up substantial rights by signing it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid in the balance, notwithstanding, shall continue in full force and effect.

Club Policies

Background:

 

Mountain Hart Dive Club LLC. was created to fill the need of the Loveland/Northern Colorado Community. We focus on the Safe Exploration of the sport of Springboard Diving. Safety is at the forefront of our club, but we also like to have fun. We welcome all ages and experience levels with the only requirement being the ability to pass a swim test and be comfortable in the deep end of the pool.  

Tuition and Travel Fees:

 

A common challenge athletic clubs face is timely payment of tuition, as well as timely reimbursement for coaching travel expenses for meets. It has also been known that athletes have backed out of meets last-minute, leaving participating families and coaching staff to foot the bill. As a result there will be a Travel fee required of families participating in meets. This is a non-refundable fee that will cover coaching expenses during the event. We hope this will start our club off with clear and honest communications and a greater commitment to the team and the team goals. Fees will be presented at the discussion of each meet to cover entry fees, travel expenses, and room and board for the athletes and coaches.

Registration: Mountain Hart Dive Club LLC is insured through Amateur Athletics Union (AAU). All divers who participate in our program will be required to obtain a membership through the association. Failure to do so will result in the athlete being removed from the club until these stipulations are met.

Athlete/Coach Safety:

 

There were several sports that had horrific incidences involving inappropriate interactions between coaches and athletes. As a result, the National Governing Bodies (NGBs) for diving (AAU and SafeSport) have mandated policies that were disseminated to clubs on September 13, 2018. As Mountain Hart Dive Club LLC. is a new entity we have tailored our Athlete handbook to these policies AAU. We will be in communication of any and all policy changes as they are brought to our attention.


Policies for Acknowledgement

Tuition and Travel Fee Policies:

-- Tuition for all practices is due on the first of the month. Invoices for requested practice package will be sent out on the 25th and no later than the 28th of the prior month. All members of the club are on a Month to Month basis with the club. We will check in with you each month when we start the billing cycle to confirm by either text or email any changes and dates that the athlete will be at practice.

-- Prior to ANY participation of an athlete in any sort of training (dryland, dryboard, diving), all past tuition and reimbursements for meets/training camps must be paid in full. If payment is not current, and the athlete shows up anyway, they will be asked to leave or wait in the spectator area until transportation arrives. Continuous non-payment will result in dismissal from our program. Please keep a record of any payments you have made so that in the event of a discrepancy, we can compare records.

-- Late fees of $15 will be assessed 15 days after notification of tuition, and the athlete will not be allowed to participate in any training activities until tuition and late fees are paid in full. Tuition is payable online through QuickBooks or via check. 

-- For the competitive team, athletes are expected to participate in meets for which they have qualified. If you opt to not attend, you must notify the coaches immediately after qualifying so that we may notify the meet director and any other athletes allowed to attend due to your/your athlete’s absence. If you commit to a meet and opt to not attend at the last minute, you are still responsible for your share of expenses. Athletes with unpaid expenses will not be allowed to participate in any club activities until these costs are paid in full. We will send out a form for the sign up of the event, athlete will not be entered into the event until the invoice is paid.

-- For any returned checks or payments there will be a $50 charge per event.

 

-- Beginner and Intermediate / High School group athletes are welcome to attend and compete at any AAU and/or USA Diving meets (at the coaches’ discretion), and will be assessed a coaching fee of $50/day. This fee must be paid prior to attending the meet.

Please note: We understand this may sound harsh, but we are committed to ALL of the athletes in the club and it is our duty to make sure everyone is treated fairly. Setting clear and consistent communication from the beginning gives way for a better experience with the club.

Registration Policies:

-- All athletes must be correctly registered with AAU, affiliated with Mountain Hart Dive Club LLC, and current with their registration. Registration must be verifiable by coaches before an athlete is allowed to participate in any team training or activities. NO VERIFICATION, NO PARTICIPATION. If you do not appear on our AAU roster, you are not correctly registered.

-- At any AAU/USA Diving meets, athletes must be affiliated with Mountain Hart Dive Club LLC, not “unattached.”

Athlete/Coach Safety Policies:

-- We must insist on a “buddy system” during transit from the dryland Facility to pool or other training facility.

-- If there is a change in the person responsible for picking up or dropping off your athlete you will be required to inform the club in writing via text or email of the change and the identity and contact information of who will be responsible.  

-- Athletes are NOT to be on the pool deck or in the dryland facility EVER without a coach plus at least one more athlete/coach/parent/guardian present. During any private lessons, a parent/guardian/another coach must be present. Verify before dropping off your athlete that there will be other coaches or athletes present during training times. For parents/guardians driving their athletes to and from practice, plan to drop your athlete off and pick them up within 10 minutes of the starting and ending time of practices.

-- Athletes are only permitted to use equipment in which a coach is supervising at the time. Using equipment that is not being monitored could result in suspension from the club.   

General Lesson / Team Policies:

-- If you are registered in our lesson program and miss a lesson, we will work with you to try to schedule a make-up; however, make-up practice is not guaranteed.

-- We expect you to be at all scheduled practices, on time. If you must miss a practice or cannot make it on time, you need to notify the coaches at least 3 hours in advance. Consistent absences/tardiness and/or lack of effort during practices may result in suspension.

-- We reserve the right, for any reason, to dismiss anyone from the club, without refund of any tuition or travel fees.

 

All athletes must read and sign this agreement. All athletes and Parents are required to sign this agreement.
